United States: August 2026 Visa Bulletin — India update
USCIS is using Final Action Dates for employment-based adjustment filings in August. India EB-2 is unavailable for the remainder of the fiscal year, while India EB-1 and EB-3 dates remain unchanged.
The filing chart for August
The US Department of State has issued the August 2026 Visa Bulletin. For employment-based adjustment-of-status filings in August, USCIS is using the Final Action Dates chart rather than the Dates for Filing chart. That selection is important because the Final Action Dates chart controls which applicants may file in the United States during the month.
India employment-based snapshot
For India, the EB-1 Final Action Date remains 15 October 2022. India EB-2 is unavailable for the remainder of the fiscal year after its annual limit was reached. India EB-3 and Other Workers remain at 1 January 2014. An unavailable category cannot receive further visa-number allocations until availability returns.
Wider movement in the bulletin
The bulletin records limited forward movement in several categories. EB-3 advanced for most chargeability areas other than India and the Philippines; China EB-1 moved to 1 July 2023; and EB-4 advanced to 15 October 2022. No movement was shown in the EB-5 categories.
What to watch next
The Department of State has flagged the possibility of future pressure on India EB-1, China EB-2, and Philippines EB-3 as fiscal-year demand develops. For India EB-2, visa availability may be revisited when the new US fiscal year begins on 1 October 2026. Applicants should check the bulletin and the applicable USCIS filing-chart announcement for the month in which they intend to file.
