Canada: Policy clarification regarding OINP
Canadian PR through OINP to not accept fully remote work arrangements
If you are aiming for Canadian Permanent Residency (PR) through the Ontario Immigrant Nominee Program (OINP), a major policy clarification has just been confirmed.
Ontario immigration authorities have made it official: Fully remote work arrangements are NOT accepted for employer-supported OINP applications.
Even if an employer is based in Ontario, a 100% remote job offer will no longer provide a valid foundation for an OINP nomination. While you can still qualify under a hybrid setup if you regularly report to and work from an eligible, physical Ontario business location, however, home offices do not count. Supporting employers must possess a permanent, physical commercial workplace in Ontario that meets distinct revenue and local staffing thresholds depending on location:
• Greater Toronto Area (GTA): Minimum $1M gross annual revenue and 5 full-time Canadian citizens/PRs at that location.
• Outside the GTA: Minimum $500k gross annual revenue and 3 full-time Canadian citizens/PRs at that location.
The province is placing immense scrutiny on employment relationships. The sponsored role must be proven as "urgently necessary" to the business operations, and officials will assess operational substance (where you report, where payroll is processed, and who directly supervises you).
What should you do next?
• For employees: Before counting on a job offer for your PR pathway, double-check whether the role is designated as fully remote or hybrid. Confirm your employer has a qualifying physical workplace.
• For Employers: Review your remote and hybrid workforce structures to ensure your candidate sponsorships remain compliant under the consolidated Ontario Workforce Priority (OWP) stream rules.
Staying ahead of provincial shifts is critical as Canada tightens temporary migration pathways.
